Suspended Driver’s License? – Consider Bankruptcy.

A person may have their license suspended due to traffic violations, such as for being an uninsured driver, having speeding tickets that go unpaid, and so forth. A license may even be suspended due to criminal fines.

By filing a chapter 13 bankruptcy, a license can be reinstated almost immediately. I have helped clients reinstate licenses that were suspended for both traffic violations and criminal fines. Only a chapter 13 bankruptcy allows for the reinstatement of a license, not a chapter 7 bankruptcy, however.

The policy for allowing the reinstatement of a license while a person is in chapter 13 bankruptcy boils simply down to the fact that by suspending a license for non-payment of a fine is essentially an attempt to collect a debt. However, a chapter 13 bankruptcy reorganizes your financial obligations, and the Courts and the Department of Motor Vehicles must allow for your license to be reinstated.
